Immigration Attorneys Sue U. S. Customs and Border Protection

The U.S. Customs and Border Protection is facing legal action brought by immigration attorneys that could force major changes along the U.S. and Mexico border. 

Concern is being raised because CBP officers are purportedly detaining U.S. citizens for additional inspection if they present birth certificates to authorize entry that were registered by midwives in the United States.  During their detention, officers are allegedly interrogating them for hours under the suspicion of false documents.  Using threats, officers try to secure “confessions” from citizens of fraudulently registering as born in Texas, according to court filings.

An US-born citizen can have difficulty getting a passport from the State Department if their birth certificate is registered by a midwife. Without a passport, they are then carefully scrutinized by CBP on trying to re-enter the country and, again, their birth certificate’s authenticity is questioned, leaving them in an endless cycle trying to re-enter the US.

After the CBP officials declare the detainees as being inadmissible to the U.S., they are stripped of their documents and sent back to Mexico, immigration attorneys stated. When applying for entry at an international bridge, if a person is not considered a U.S. citizen, he or she will not have constitutional rights and will not likely have legal representation readily available. As this risk is not well known, many people are falling into its trap.

Government officials cite a long history of documents forged for Mexican-born children starting as early as the 1960s. Around 75 midwives have been convicted after they made statements in court declaring they had indeed committed birth certificate fraud. However, not every child delivered by a midwife was born in Mexico and provided false documents. The difficulty is trying to determine which documents are valid.

As litigation continues to progress, those waiting for a passport are still having issues obtaining one.  For the same reasons they are denied passports by the Department of State, they are being held by CBP officials for further questioning and document inspection.
